The national commissioner of the Nigeria Data Protection Commission (NDPC), Dr. Vincent Olatunji has officially inaugurated the National Committee for the General Application and Implementation Directive (GAID) of the Nigeria Data Protection Act 2023 (NDP Act).
This committee, inaugurated on Wednesday, September 6, 2023, is part of a series of crucial regulatory measures taken by the commission to streamline compliance procedures under the Act.
The committee’s primary responsibilities include offering guidance on technical and organizational measures that data controllers and data processors must adopt to ensure data subject privacy, data security, and data sovereignty. Additionally, the GAID aims to clarify critical terms and concepts such as child consent, data subjects’ rights, lawful basis of data processing, registration of data controllers and data processors and cross-border data transfers, among others.
According to a statement from the commission’s head of the media unit, Itunu Dosekun, the committee is composed of eight members, with Mr. Babatunde Bamigboye, Esq., the commission’s head of legal, enforcement and regulations, serving as the chair. Mr. Tokunbo Smith, representing the Association of Licensed Data Protection Organisations of Nigeria, will act as co-chair, while Hauwa Hadejia, Esq., will serve as the secretary. Other committee members include Ozoemena F. Nwogbo, Esq., Mr. Gbenga Sesan, Mr. David Daser, Femi Daniels, Esq. and Ifeoma Peters, Esq.
This development underscores the commitment of the Nigeria Data Protection Commission to fostering data protection and privacy in Nigeria while ensuring that organisations adhere to the provisions of the NDP Act 2023. The newly inaugurated committee is expected to play a pivotal role in achieving these objectives.
